Marketing Mosaic

Terms of Service

Effective September 17, 2026

Agreement

These Terms of Service govern access to and use of Marketing Mosaic, multi-brand marketing analytics in one view, operated by Heartland (“we,” “us,” or “our”). By signing in or using Marketing Mosaic, you agree to these terms and to our Privacy Policy.

If you do not agree, do not use Marketing Mosaic. If you use Marketing Mosaic on behalf of Heartland, you represent that you are authorized to do so.

The service

Marketing Mosaic is an internal, invite-only dashboard. We issue accounts to Heartland staff and other people we authorize. There is no public registration, and access may be limited to specific brands.

We may change, suspend, or discontinue features at any time, including connected Google products, AI tools, reports, and third-party data sources.

Accounts and access

You must use the account we issue to you. Credentials are personal: do not share your password or let others use your sign-in. You are responsible for activity under your account.

We may suspend or revoke access if you leave Heartland, change roles, violate these terms, or if we need to protect the service, client data, or other users.

Acceptable use

You agree not to:

  • Access brands, Google connections, or data you are not authorized to see
  • Share logins, scrape the service, or attempt to bypass role or brand restrictions
  • Use Marketing Mosaic to violate law, Heartland policy, or third-party terms (including Google API terms)
  • Reverse engineer, overload, or interfere with the service except as we expressly allow
  • Upload or submit content you do not have the right to use in Marketing Mosaic

Confidentiality

Marketing Mosaic holds confidential Heartland and client information, including brand records, marketing metrics, Google connection data, reports, and audit history. You may use that information only for authorized Heartland work, and you must not disclose it outside Heartland except as your role and our policies allow.

Third-party services

Features may depend on third parties, including Google, Fireworks, Ahrefs, Resend, the National Weather Service, FRED, and our hosting provider. Their terms and privacy policies apply to their services. We are not responsible for third-party outages, data accuracy, or changes to their APIs.

AI features

Ask Milo and AI overviews can be incomplete, outdated, or wrong. They are aids for authorized users, not professional, legal, or financial advice. You remain responsible for checking outputs and for any decision you make using Marketing Mosaic.

Intellectual property

Heartland and its licensors own Marketing Mosaic, including its software, design, and trademarks. These terms do not grant you any ownership interest. Client and brand content remains subject to the rights of Heartland and the relevant clients.

Disclaimer of warranties

Marketing Mosaic is an internal tool provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that metrics or AI output will be accurate or complete.

Limitation of liability

To the fullest extent permitted by law, Heartland and its personnel are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of Marketing Mosaic. Our total liability for any claim relating to the service is limited to fifty US dollars (US $50). Some jurisdictions do not allow certain limitations; in those cases, the limitation applies to the maximum extent permitted.

Changes to these terms

We may update these terms as the service changes. The effective date at the top of this page will change when we do. Continued use of Marketing Mosaic after updated terms are posted constitutes acceptance of the new terms.

Governing law

These terms are governed by the laws of the United States, without regard to conflict-of-law rules. Courts of competent jurisdiction will hear disputes, except where applicable law requires otherwise.
